Probate allows the court to distribute your estate to the proper heirs.  This process could include creditor claims, resolving disputes among heirs, and selling or liquidating assets to distribute what you leave behind. 

Beyond the emotional cost of probate is the financial burden to petition the courts for the legal distribution of the deceased’s property in the event of a dispute. Even a smooth process can be expensive. Some of the expenses will come from the estate itself, which inevitably will decrease the amount intended for heirs.
